PLEASE READ THESE TERMS OF SERVICE CAREFULLY. BY ACCESSING OR USING THE WHICHCREW PLATFORM (THE “SERVICE”), YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS. IF YOU DO NOT AGREE, YOU MUST IMMEDIATELY DISCONTINUE USE OF THE SERVICE. These Terms constitute a binding legal agreement between you (“User” or “you”) and WhichCrew (“WhichCrew,” “we,” “us,” or “our”), a platform operated in Long Beach, California.
1. WhichCrew Is an Informational Directory Only
WhichCrew is strictly an informational, crowdsourced directory of contractor projects. Contractor listings are either submitted by homeowners or compiled by WhichCrew from publicly available records (such as state contractor-license data) to populate the directory. A listing that WhichCrew compiles contains only factual, public, or self-provided information — such as a business name, trade, license number, or contact details — and is not, and must not be read as, a rating, review, recommendation, endorsement, or ranking. WhichCrew does not act as a contractor referral service, employment agency, staffing firm, or professional services provider of any kind. We do not screen, vet, verify, license, endorse, recommend, or guarantee any contractor, business, tradesperson, or the quality, safety, legality, suitability, or outcome of any work described in any listing, and we do not manually determine, sell, or assign any contractor's position or ranking. All ratings, vouches, photographs, notes, and reviews published on the Service are user-generated content reflecting solely the opinions and experiences of the individual homeowners who posted them, and do not represent the views, findings, or endorsements of WhichCrew in any manner. Any ranking or “Top Pros” ordering is generated automatically and solely from these neighbor-submitted vouches. WhichCrew is not a party to any agreement, contract, or transaction between any user and any contractor.
2. Eligibility
The Service is intended solely for individuals who are at least eighteen (18) years of age and who are able to form a legally binding contract. By accessing or using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to agree to these Terms. The Service is not directed to children, and WhichCrew does not knowingly collect personal information from anyone under 18. If we learn that we have collected personal information from a person under 18, we will delete it. If you are the parent or guardian of a minor who has used the Service, please contact us at hello@whichcrew.com.
3. No Professional, Hiring, or Legal Advice
Nothing on the Service constitutes a recommendation, referral, or advice to hire or not hire any contractor or professional. You are solely and exclusively responsible for your own hiring decisions, including without limitation: independently verifying a contractor's current state licensing, insurance certificates, bonding status, references, permit history, and professional qualifications before engaging their services. WhichCrew disclaims all liability for any harm, loss, or damage arising from your reliance on information found on the Service for any hiring or purchasing decision.
4. Contractor Licensing — California (CSLB)
Because contractor listings are submitted by homeowners or compiled by WhichCrew from public records, and in either case are not screened by WhichCrew for current licensure, some individuals shown on the Service may not hold a current professional contractor's license. In California, the Contractors State License Board (“CSLB”) requires a license for most home-improvement work where the combined labor and materials cost is $500 or more; unlicensed individuals may legally perform only minor handyman work below that threshold and may not advertise contractor services. WhichCrew does not verify CSLB licensure and makes no representation that any listed individual is licensed, bonded, or insured. Before hiring anyone for work at or above the California $500 threshold, you are solely responsible for confirming the contractor's current license, bond, and insurance status directly with the CSLB at cslb.ca.gov. The presence or absence of a license number on any WhichCrew listing is not a substitute for that verification.
5. Disclaimer of Liability for Contractor Performance
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WHICHCREW AND ITS OWNERS, OPERATORS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SUCCESSORS (COLLECTIVELY, “WHICHCREW PARTIES”) ARE NOT LIABLE, AND EXPRESSLY DISCLAIM ALL LIABILITY, FOR: (A) THE PERFORMANCE, CONDUCT, ACTS, ERRORS, OR OMISSIONS OF ANY CONTRACTOR OR THIRD PARTY; (B) ANY PROPERTY DAMAGE, PERSONAL INJURY, FINANCIAL LOSS, OR OTHER HARM ARISING FROM WORK PERFORMED OR ARRANGED THROUGH INFORMATION FOUND ON THE SERVICE; (C) A CONTRACTOR'S LICENSING, BONDING, INSURANCE STATUS, OR COMPLIANCE WITH ANY APPLICABLE LAW OR REGULATION; OR (D) ANY DISPUTE ARISING BETWEEN A USER AND A CONTRACTOR. THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.
6. User-Generated Content: Accuracy, Ownership, and Responsibility
User Content submitted to the Service — including project descriptions, ratings, vouches, photographs, and notes (collectively, “User Content”) — is provided by users. Separately, WhichCrew may itself publish baseline directory entries compiled from publicly available records (such as contractor-license data); those entries consist only of factual, public, or self-provided information and are not User Content, ratings, reviews, or endorsements. By submitting User Content, you represent and warrant that: (a) the content is accurate and truthful to the best of your knowledge; (b) you have personal knowledge of the project described; (c) the content does not infringe any third-party intellectual property, privacy, or defamation rights; and (d) you are authorized to post content associated with the property address provided. You assume sole and exclusive legal and financial responsibility for all User Content you submit. WhichCrew expressly disclaims any liability for the accuracy, completeness, legality, or reputational impact of any User Content. With respect to User Content, WhichCrew acts as a passive conduit and qualifies as an interactive computer service under Section 230 of the Communications Decency Act (47 U.S.C. Section 230). Accordingly, WhichCrew is not the publisher or speaker of any User Content and is not liable for any claims arising from such content. By submitting User Content, you grant WhichCrew a perpetual, irrevocable, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, display, distribute, modify, adapt, and create derivative works of such content for any purpose in connection with operating, improving, and promoting the Service, including without limitation use in marketing, advertising, social media, email communications, press materials, case studies, demos, and other promotional content, with or without attribution. This license is irrevocable except as otherwise provided in our Privacy Policy or upon a valid account deletion or content-removal request, subject to standard backup retention timelines; otherwise it survives termination of your account.
7. Community Content Standards and Prohibited Conduct
WhichCrew depends on honest, firsthand accounts from real neighbors. When you post any User Content, you agree that it reflects your own genuine, firsthand experience, and you agree that you will not:
(a) post a review, rating, vouch, or project that is fake, fabricated, or that does not reflect a real project you have personal knowledge of;
(b) offer, solicit, give, or accept any payment, discount, or other incentive in exchange for a review or vouch, or otherwise attempt to manipulate ratings, vouches, or rankings;
(c) post content about your own business, a business you are affiliated with or compensated by, or a competitor, or otherwise post content in which you have an undisclosed conflict of interest;
(d) impersonate any person or business, or misrepresent your identity, affiliation, or relationship with any contractor;
(e) post content that is defamatory, knowingly false, harassing, threatening, hateful, or obscene, or that violates any person's privacy or publicity rights;
(f) post another person's private or personal information, or content that infringes any intellectual-property right;
(g) post spam, chain content, or unsolicited advertising or promotional material;
(h) introduce viruses or malicious code, or attempt to gain unauthorized access to the Service, other users' accounts, or WhichCrew's systems; or
(i) use the Service in violation of any applicable law or regulation.
WhichCrew may remove any content that violates these standards and may warn, suspend, or terminate any account, in its sole discretion. Because the Service is a forum for genuine opinion, WhichCrew is under no obligation to remove content merely because it is unfavorable to a contractor or business, and truthful, good-faith reviews and ratings are permitted even where a contractor disputes them.
8. Address Listings, Uniqueness, Ownership Claims, and Takedown Process
Home listings on the Service are publicly visible by default at the neighborhood level. WhichCrew never publishes a home's exact street address, house number, or unit; map pins are placed at an approximate neighborhood-level offset. The exact street address is stored privately and used only to derive the neighborhood, approximate map location, and enforce the listing-uniqueness rule described below. Each physical residential address may be claimed by only one user account on the Service. Uniqueness is enforced by the geocoded coordinates of the submitted address. WhichCrew does not verify property ownership at the time of submission. Some home listings are created by WhichCrew on a resident's behalf, with that resident's permission, to help populate a neighborhood. Such listings are attributed accordingly (for example, “pinned by WhichCrew on the resident's behalf, with their permission”), follow the same neighborhood-level privacy rules as any other listing, are recorded together with the permission WhichCrew relied on, and may be claimed, edited, or removed by the resident at any time using the process below. If you believe an address listing on the Service concerns your property and was created without your authorization, or you otherwise wish to have a listing concerning your property removed, you may submit a formal dispute or removal request by using the “Is this your home?” feature on the relevant listing page. All such requests must be accompanied by satisfactory proof of residence or ownership (such as a government-issued photo ID or utility bill). WhichCrew will review submitted requests manually, at its sole discretion, and at a time and in a manner of its own choosing. WhichCrew makes no representations regarding the timeline for review and assumes no liability for any delay in processing a claim or takedown request. Submission of a request does not guarantee removal or modification of a listing. WhichCrew reserves the right to deny any request that does not meet its verification standards or that it determines, in its sole judgment, to be fraudulent or incomplete.
9. Photos, Moderation, and Content Removal
Projects and photographs are provided by homeowners — or posted by WhichCrew on a resident's behalf with their permission — and are published on the Service immediately, becoming publicly visible without prior review. During the current beta period, WhichCrew does not perform automated pre-screening of uploads. Moderation is report-based: any user may report a project, photograph, or listing using the reporting features on the Service, and reports are sent directly to the site administrator. Reported content is reviewed by a human and removed if it violates these Terms or the content standards described herein. WhichCrew may also extract embedded photo metadata (such as EXIF GPS coordinates, where present) to surface content whose location appears mismatched with the associated listing for administrative review. WhichCrew does not guarantee that all content is reviewed, screened, or approved before or after publication. WhichCrew reserves the right, but not the obligation, to remove, modify, withhold, or restrict access to any content at any time, without notice, and at its sole discretion. Users acknowledge that no system of moderation is perfect and that WhichCrew is not liable for content that escapes detection.
10. Account Creation and Authentication
Accounts may be created and accessed via passwordless email magic links, third-party authentication providers (including Google), or other methods WhichCrew may offer from time to time. By creating an account, you represent that the email address you provide is yours and that any third-party authentication provider you use is authorized for your use. You are responsible for maintaining the security of your email inbox and authentication credentials. WhichCrew may impose rate limits, account-age restrictions, per-account home and project caps, and other operational limits at its sole discretion to prevent abuse. WhichCrew logs authentication attempts (including IP addresses) for security, abuse-prevention, and rate-limiting purposes as described in the Privacy Policy.
11. Electronic Communications and Consent
By creating an account or using the Service, you consent to receive communications from WhichCrew electronically, including by email and through the Service, and you agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing. These communications include transactional and service messages — such as sign-in links, security and account notices, ownership-claim and verification updates, and notices about your listings — which are necessary to operate your account and which you may not be able to opt out of while you maintain an account. We may also send optional “neighborly” update emails, such as summaries of activity on your projects; you can opt out of those at any time using the unsubscribe link in the email or in your account settings, without affecting transactional messages. To withdraw consent to electronic communications generally, you must stop using the Service and may close your account.
12. Address Verification (Verified Home Badge)
Homeowners may optionally request a “Verified Home” badge on their listing by submitting proof of residence (such as a utility bill, lease, mortgage statement, or government-issued photo ID showing the matching address). All verification documents are stored in restricted, non-public storage and are accessible only to authorized WhichCrew personnel for review purposes. Verification documents are automatically deleted from WhichCrew's systems upon completion of the manual review, whether the request is approved or denied, and in any event if the request remains undecided for thirty (30) days, at which point the request is marked expired and you are invited to resubmit. WhichCrew makes no representation regarding the timeline for verification review and assumes no liability for any delay. Issuance of a Verified Home badge reflects only that the user submitted documentation consistent with the claimed address as of the date of review; it does not constitute an endorsement, a guarantee of continued residence, or any representation about the user, the property, or any contractor. WhichCrew reserves the right to revoke any Verified Home badge at any time, at its sole discretion.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF THE WHICHCREW PARTIES TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE, THESE TERMS, OR YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, SHALL NOT EXCEED THE GREATER OF: (A) ONE HUNDRED UNITED STATES DOLLARS ($100.00); OR (B) THE TOTAL AMOUNT YOU HAVE PAID TO WHICHCREW IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. THE WHICHCREW PARTIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU IN FULL.
14. Binding Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service (a “Dispute”) shall be resolved exclusively by final and binding individual arbitration administered by JAMS (formerly Judicial Arbitration and Mediation Services) under its Streamlined Arbitration Rules and Procedures, as amended by these Terms. Arbitration shall take place in Los Angeles County, California, or, at your election, via videoconference. The arbitrator shall have exclusive authority to resolve any Dispute, including without limitation any claim that all or any part of these Terms is void or voidable. YOU AND WHICHCREW EACH EXPRESSLY WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION, CONSOLIDATED ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR REPRESENTATIVE PROCEEDING OF ANY KIND. Any arbitration award may be entered as a judgment in any court of competent jurisdiction. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction in Los Angeles County to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, or other intellectual property rights.
15. Governing Law and Venue
These Terms and any Dispute arising hereunder shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-laws principles. To the extent any matter is not subject to arbitration under Section 14, you and WhichCrew each irrevocably consent to the exclusive personal jurisdiction and venue of the state and federal courts located in or serving Los Angeles County, California, and waive any objection to such jurisdiction or venue.
16. Privacy Policy
Your use of the Service is also governed by WhichCrew's Privacy Policy, which is incorporated herein by reference. The Privacy Policy describes how WhichCrew collects, uses, stores, and discloses your personal information, including address data submitted to the Service, and outlines your rights under applicable California privacy laws, including the California Online Privacy Protection Act (CalOPPA) and the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA). By using the Service, you agree to both these Terms and the Privacy Policy. In the event of a conflict between these Terms and the Privacy Policy with respect to data practices, the Privacy Policy shall control.
17. Indemnification
You agree to indemnify, defend, and hold harmless the WhichCrew Parties from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of or access to the Service; (b) your violation of these Terms; (c) your User Content; (d) your violation of any third-party right, including any intellectual property, privacy, or defamation right; or (e) any dispute between you and any contractor or third party.
18. Modifications to the Terms
WhichCrew reserves the right to modify these Terms at any time. We will notify users of material changes by updating the “Last updated” date at the top of this page and, where appropriate, by providing additional notice through the Service. Your continued use of the Service after any modification takes effect constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue use of the Service.
19. Termination
WhichCrew reserves the right, at its sole discretion and without notice or liability, to suspend or terminate your access to the Service, remove your content, or deactivate your account for any reason, including violation of these Terms or conduct that WhichCrew determines, in its sole judgment, to be harmful to other users, the platform, or third parties.
20. Copyright Complaints (DMCA)
WhichCrew respects the intellectual property rights of others and responds to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe content on the Service infringes your copyright, send a written notice to our designated agent:

Your notice must include: (a) identification of the copyrighted work claimed to be infringed; (b) identification of the material claimed to be infringing and information reasonably sufficient to locate it on the Service (such as the listing or photo URL); (c) your name, address, telephone number, and email address; (d) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; (e) a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf; and (f) your physical or electronic signature. Upon receipt of a valid notice, WhichCrew will remove or disable access to the identified material and take reasonable steps to notify the user who posted it. If you believe your content was removed in error, you may submit a counter-notification containing the information required by 17 U.S.C. § 512(g)(3). WhichCrew may, in appropriate circumstances, terminate the accounts of users determined to be repeat infringers.
21. Prohibited Commercial Use and Scraping
You may not use the Service for any commercial purpose competitive with WhichCrew. The Service, including its selection, arrangement, and compilation of listings, and its design and “look and feel,” is protected by intellectual-property and other laws, and WhichCrew reserves all rights not expressly granted to you. Subject to your compliance with these Terms, WhichCrew grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for your own personal, non-commercial purposes only. Automated crawling, scraping, harvesting, indexing, or data extraction of any portion of the Service (including user reviews, contractor names, photographs, or neighborhood data) by any robot, spider, bot, or script is strictly prohibited without our express prior written consent, except that operators of public search engines may crawl the Service solely to create publicly available searchable indices in accordance with our robots instructions. Any violation of this Section terminates the license granted above. We reserve the right to block, rate-limit, or pursue all available legal remedies against any party that violates this Section.
22. General Provisions
Entire Agreement. These Terms, together with the Privacy Policy and any other policies expressly incorporated by reference, constitute the entire agreement between you and WhichCrew regarding the Service and supersede all prior or contemporaneous agreements, understandings, or communications.
Severability. If any provision of these Terms is held invalid, unlawful, or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be enforced to the maximum extent permissible and severed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. Notwithstanding the foregoing, if the class-action or representative-action waiver in Section 14 is found unenforceable as to a particular claim, that claim shall be severed and adjudicated in a court of competent jurisdiction, while all other claims remain in arbitration.
No Waiver. WhichCrew's failure to enforce any provision of these Terms shall not constitute a waiver of that or any other provision.
Assignment. You may not assign or transfer these Terms, or any rights or obligations hereunder, without WhichCrew's prior written consent. WhichCrew may freely assign these Terms, including in connection with a merger, acquisition, reorganization, financing, or sale of assets.
No Third-Party Beneficiaries. Except for the WhichCrew Parties, these Terms do not create any third-party beneficiary rights.
Force Majeure. WhichCrew is not liable for any failure or delay in performance resulting from causes beyond its reasonable control.
Survival. Provisions that by their nature should survive termination — including those concerning User Content licenses, disclaimers, limitation of liability, indemnification, arbitration, and these General Provisions — survive termination of your account or these Terms.
Headings. Section headings are for convenience only and do not affect the interpretation of these Terms.
